A Gilmer man has been sentenced to 10 years probation after pleading guilty to manslaughter.
20-year-old Benjamin Lee Powers initially was charged with Criminally Negligent Homicide but according to the Upshur County District Attorney’s office, evidence presented later revealed grounds for manslaughter.
18-year-old Caderrius Green was killed while riding as a passenger in Powers’ car. Powers attempted to pass a vehicle in a no pass zone on FM 49 near Gilmer and rolled the vehicle several times in what the District Attorney’s office calls an act of road rage.
Drugs or alcohol were not involved in the crash.
