The sixth Court of Appeal in Texarkana upheld Wednesday an Upshur County jury’s conviction against 45-year-old Kevin Leray Henderson and an 80-year sentence for habitual Indecency with a Child.
According to Upshur County District Attorney Billy Byrd, the facts of the case involved the defendant exposing his genitals to a young child at an apartment complex in Gilmer. The mother of the child saw the act, grabbed her child and drove to the Gilmer Police Department.
After the jury found Henderson guilty, he chose to have Judge Luaren Parish preside over the punishment phase of the trial. Henderson was punished as a habitual offender where his range of punishment was between 25 and 99 years or life in prison.
“We are very thankful to our jury who convicted the defendant and Judge Parsih for a strong and deserved punishment,” said Byrd.
The Gilmer Police Department investigated the crime.
